Terms & Conditions

1) Definitions

• Application: The electronic platform owned and operated by Halaly Kuwait Agricultural Contracting Company.
• Company: Halaly Kuwait Agricultural Contracting Company.
• User: Any person who uses or registers in the Application.
• Content: Includes text, images, data, records, pedigrees, and advertisements.
• Notebook (Daftar): A digital monthly or annual subscription service that lets users manage their livestock.
• Services: All activities offered through the Application (veterinary, sheep shearing, consultations, medicines, transport, etc.).
• Service Provider: Any third party offering services through the Application.

2) Acceptance of Terms

By using the Application, you agree to be bound by all the Terms & Conditions. If you do not agree, you must immediately stop using the Application.

3) Eligibility

• The user must be 18 years of age or older.
• The user bears full responsibility for the accuracy of their data.
• The Company may suspend or cancel any account without prior notice in the event of a breach of these terms.

4) Nature of the Service

The Application is a platform for displaying, selling, and buying all livestock: feed, poultry, pigeons and their breeds, horses and their breeds, livestock and their breeds (especially sheep).

The Application is not considered a direct party in any sale or purchase between users (unless expressly stated otherwise).

5) Notebook (Daftar) — Subscriptions

Service scope:

• Digital record for managing livestock data.
• Access to the related services marketplace.
• Scheduling and management of appointments.
• Operational and health reports based on entered data.

Auto-renewing subscription via App Store / Google Play:

• Activation occurs through a monthly or annual subscription at the prices displayed in the Application.
• The subscription renews automatically unless cancelled at least 24 hours before the end of the current period.
• The renewal fee is charged within 24 hours of the end of the current period.
• You can manage your subscription or turn off auto-renewal in your App Store or Google Play account settings.
• The package is activated immediately upon payment and remains valid until the end of the paid period even if auto-renewal is cancelled.

Refunds:

• Payments made directly to the Company (outside the App Store) are non-refundable after activation.
• App Store subscriptions are subject to Apple’s refund policy via reportaproblem.apple.com.
• Google Play subscriptions are subject to Google Play’s refund policy.

6) Use of the Notebook

The user undertakes to:

• Enter correct and accurate livestock data.
• Use the service for lawful purposes only.
• Refrain from misusing the system, attempting to hack it, or tampering with data.

The user bears full responsibility for any inaccurate information entered.

7) Services and Service Providers

Services are provided by independent providers; the Application bears no direct responsibility for service quality.

The agreement and execution responsibility lies between the user and the service provider.

The Application may suspend or remove any service provider that fails to comply with the standards.

8) Booking and Appointment Management

Services are booked through the Notebook based on the available appointments.

The user must attend or cancel the appointment with sufficient advance notice.

Fees may be charged for late cancellation or no-shows.

9) Liability and Disclaimer

The Application is not liable for any damages resulting from:

• The user’s mismanagement of livestock.
• The user’s negligence or failure to follow instructions.
• Errors or shortcomings of service providers.

All consultations provided are advisory and do not replace direct on-site assessment.

10) Responsibility for Information and Pedigrees

The user is responsible for:

• The accuracy of breed information.
• The accuracy of pedigree data (sire, dam, grandsire, granddam).
• The accuracy of the pedigree booklet.

The Company does not guarantee the accuracy or validity of pedigrees. The Company is not responsible for any dispute arising from the falsification of breeds, false information, or ownership claims. Pedigree authentication is referred to accredited governmental or private authorities.

11) Advertisements and Sales

The advertiser bears full responsibility for the accuracy of the advertisement, the description of the animal or product, and the price.

It is prohibited to: present misleading information, manipulate prices, or post content contrary to law or public morals.

The Company may delete any advertisement without giving a reason.

12) Reporting Violating Content

Any user may report violating content within the Application via the "Report" button.

The Company will review the report within 24 hours and take appropriate action (content removal, account suspension, etc.).

To report intellectual property infringement, please contact us via the support email listed at the end of these terms.

13) Payments and Transactions

All financial transactions are at the user’s own responsibility.

The Company is not responsible for: fraud, payment delays, or financial disputes between users.

If a payment gateway is used: service fees may apply, and the Company is not responsible for banking outages.

14) Animal Examination and Veterinary Responsibility

The Company does not provide a health warranty for animals.

The Company is not responsible for: diseases, death, or genetic defects.

15) Intellectual Property

All rights to the Application are reserved by the Company.

It is prohibited to: copy the content, republish it, or use it commercially without permission.

16) Accounts and Security

The user is responsible for the confidentiality of their account and password. The Company is not responsible for any breach resulting from user negligence.

17) Misuse

The Application may not be used for:

• Fraud or scams.
• Publishing false information.
• Abuse of others.
• Selling products or animals in an unlawful manner.

18) Account Suspension

The Company may:

• Suspend the account temporarily or permanently.
• Delete any violating content.
• Take legal action when necessary.

19) Limitation of Liability

The Company is not responsible for any financial losses, direct or indirect damages, or disputes between users.

Use of the Application is entirely at the user’s own risk.

20) Changes to the Terms

The Company may modify these terms at any time. Continued use means acceptance of the modifications.

21) Governing Law

These terms are governed by the laws of the State of Kuwait. The courts of Kuwait have exclusive jurisdiction over any dispute.

22) General Disclaimer

The Application is provided "as is" without any express or implied warranties.

The Company does not guarantee: uninterrupted service availability, or that the Application is free of errors.

23) Data and Privacy Policy

The Company may collect user data for the purpose of improving the service and security.

Data will not be sold to third parties without permission (except as required by law).

Full details are available in the Privacy Policy inside the Application.

24) Pedigree (DNA) Special Terms

Entering breed (DNA) data is a legal declaration by the user of its accuracy.

The user bears full responsibility in case of forgery or providing inaccurate information.

The Application provides a DNA certificate upload feature but does not verify its validity. Certificates must be issued by pedigree specialists and accredited animal pedigree authorities, and may be subject to fees. The Company is not responsible for the DNA certificates issued by the relevant pedigree authorities.

The Company may delete any suspicious pedigree record and suspend the associated account.

25) Apple’s Relationship to the Application

Apple Inc. is not a party to this Agreement and is not responsible for the Application or its content.

Apple has no obligation to provide any maintenance or technical support services for the Application.

If the Application fails to conform to any applicable warranty, the user may notify Apple, and Apple will refund the purchase price (if any). Apple is not responsible for any other warranties.

Apple is not responsible for handling any claims relating to the Application or the user’s possession and use of it.

If any third party claims that the Application infringes intellectual property rights, the Company (not Apple) is solely responsible for investigating, defending, and settling the claim.

Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against the user.

26) Final Acknowledgment

I acknowledge and undertake that all information and data I have entered is accurate, and I bear full legal responsibility for it, and I agree to the Application’s Terms & Conditions, and I acknowledge that the Application is not responsible for any disputes, losses, or damages arising from use.

27) Indemnity

The user agrees to indemnify the Company, its management, and its employees against any claims, losses, damages, or lawsuits arising from their use of the Application or breach of these terms.
